1. Who is selling
The pieces shown on this website are sold by the company whose details appear at the top of this page (Feines Fines SLU, “Feines Fines” or “we”). You can write to us at info@feinesfines.com.
2. Scope
These Terms of sale govern the purchases you make on feinesfines.com and apply together with the Legal notice and the Privacy policy. Consumers are natural persons who buy for purposes outside their trade, business, craft or profession. Individuals and companies who buy for their professional activity (professional customers) are also bound by them, with the particulars set out in section 11. You must be of legal age to buy. By placing an order you declare that you have read and accept these terms, which we show you before you pay.
3. The pieces and availability
Each piece has a page with its description, dimensions, materials, variants and price. Photographs are illustrative: depending on your screen, colours may vary slightly. The pieces are produced in limited numbers and availability may change. If, after your order, a piece were to become unavailable, we will tell you straight away and refund everything you have paid.
4. Prices and taxes
Prices are shown in euros (EUR) and include VAT or the indirect tax that applies, unless stated otherwise. They do not include delivery costs, which you will see itemised in the basket and in the order before you pay. If the destination is outside the European Union, import duties, taxes and customs charges in the destination country may be payable by you. The price that applies is the one shown when you place the order. If we detect an obvious error in a price, we will tell you before accepting the order so that you can confirm it at the correct price or cancel it at no cost.
5. How to place an order
To buy you need a user account. You add pieces to the basket, check out, enter the delivery and billing addresses and pay. Before paying, a summary shows you the pieces, the total price, the delivery costs and the addresses, and you can correct any mistake.
You will receive an email confirmation with the order summary; the contract is considered formed at the moment we send you that confirmation. We reserve the right not to accept or to cancel an order for justified reasons (for example, lack of availability, an error in the details or signs of fraud); in that case we will refund everything you have paid. You can view your orders in My account.
6. Payment
Payment is made when you place the order, using the payment methods offered at checkout. It is processed by Shopify and its payment providers: your card or payment method details are given directly to them, and they never reach us or get stored by us. If the payment is not completed or is declined, the order is not processed.
7. Delivery
We deliver to the addresses and countries you can choose at checkout; the delivery cost and the estimated time are shown before you pay. If the piece is not in stock, the production time is shown. If no other time is indicated, we will deliver the order within 30 days of confirmation at the latest. If we do not, you may give us an appropriate additional period and, if we still fail, you may terminate the contract and recover what you have paid.
Delivery is made to the address you give. The risk of loss or damage passes to you when you, or a third party you have designated who is not the carrier, physically receive the piece. When you receive the parcel, check it: if you see any damage, note it with the carrier if possible and write to us as soon as you can, with photographs, so that we can deal with it.
8. Right of withdrawal
If you are a consumer, you have the right to withdraw from the purchase, without giving any reason, within 14 calendar days from the day on which you, or a third party you have named who is not the carrier, receive the piece. If you bought several pieces in one order that arrive separately, the period runs from the day you receive the last one.
To exercise this right, you must tell us clearly before the period expires, for example by email to info@feinesfines.com or by using the model form in the next section.
You must then send the piece back to us without undue delay and in any event within 14 calendar days of telling us, in the same condition in which you received it and preferably in its original packaging. The direct cost of returning it is borne by you. You are only liable for any diminished value of the piece resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
We will refund all payments received, including standard delivery costs (but not any extra costs of having chosen a more expensive delivery option), without undue delay and in any event within 14 calendar days of receiving your notice, using the same payment method you used. We may withhold the refund until we have received the piece or until you show that you have sent it back.
The right of withdrawal does not apply to goods made to your specifications or clearly personalised; if that is the case for a piece, we will tell you before you buy.
9. Model withdrawal form
Complete and send this form only if you wish to withdraw from the contract.
To Feines Fines SLU (email: info@feinesfines.com):
I hereby give notice that I withdraw from my contract of sale of the following goods: [piece and quantity].
Ordered on [date] / received on [date].
Name of consumer: [name].
Address of consumer: [address].
Date: [date]. Signature of consumer (only if this form is notified on paper): [signature].
10. Legal guarantee of conformity
If you are a consumer, the pieces we sell you carry a legal guarantee of three years from delivery. If a piece does not conform to the contract (it does not match the description, is not fit for the expected use, has defects…), you are entitled, at no cost, to have it repaired or replaced by us; if that is not possible or is not done within a reasonable time, you are entitled to a price reduction or to terminate the contract. Lack of conformity that becomes apparent within the first two years is presumed to have existed at the time of delivery.
To make a claim, write to us at info@feinesfines.com describing the problem and, if you can, with photographs. Normal use, natural wear and damage caused by misuse or lack of maintenance are not lack of conformity.
11. Professional customers
If you buy for your professional activity and are not a consumer, you have no right of withdrawal and no consumer legal guarantee; returns, issues and warranty are governed by what has been agreed and by the applicable civil and commercial law. Check the order when you receive it and tell us without delay about any defect or damage. If you have agreed particular terms with us in writing, they prevail over those on this page.
12. Customer service and complaints
For any question, issue, complaint or claim, write to us at info@feinesfines.com and we will try to resolve it as soon as possible. This does not affect your rights as a consumer, such as turning to the consumer authorities or to the courts.
13. Data protection
The data you give us in order to buy is processed in accordance with the Privacy policy. Please note that, if you buy, we may email you news about pieces similar to those you have bought; you can opt out with the box on the order and with the unsubscribe link in every email.
14. Applicable law and jurisdiction
These terms are governed by Spanish law. If you are a consumer and live in the European Union, this choice does not deprive you of the protection granted by the mandatory rules of your country of habitual residence. If you are a consumer, any dispute may be brought before the courts of your place of residence; in all other cases, before the courts of Ripoll.
15. Changes and languages
We may update these terms; each order is governed by the version in force when it is placed. They are available in Catalan, Spanish, English and Italian; if there is any discrepancy, the version in the language in which you placed the order prevails.
